BUILDER RAJ

Dear fellow brothers and sisters

It is request to all owners of neelkanthkingdom flats at vidyavihar to speak up about their issues regarding the possession delay of their dream homes for which we all have already payed the required amount well in advance and the builders neelkanth group and gammon India (builders to nation) have exceeded their commitment time to infinity it seems and their written commitments in the registered documents have been failed

This is begining and tip of the iceberg imagine if they cant fulfill this primary commitments what about the post possession and the maintenance of the mega-proposed structure

IT IS NOT AN ATTEMPT TO REVOLT OR FIGHT WITH ANYBODY ,I AM NOT FROM ANY OPPOSITION BUILDER LOBBY OR HAVE ANY PERSONAL GRIEVANCE AGAINST THE BUILDERS, BUT IS PLAIN FRUSTRATION AND RESPONSE TO THE SYSTEM

We are the consumers that does'nt mean that somebody can show us rosy pictures and and then recover the large sum and then fail to deliver and sit relaxed not even bothering to conduct a reporting meeting and on top of just trying to lure us by another sample flat and selection of tiles and so on, do they really think that we are so dumb and have no brains on our own to react and they can move us like a herd of sheep as they want

It is my humble attempt to at least speak about what i feel and would like to know about everyone else genuine unbiased and feeling from heart, want to write more, but would like to know that isit right or I have a misconception about the whole situation post your comments with personal details of name, mob no, flat no booked, and present residence add so we can communicate and solve the issue together in united fashion

Though not a member of Neelkanth Kingdom, I happen to by a member at Neelkanth Heights as well as Neelkanth Palms, Thane.
Be it any of the Neelkanth Projects, the story remains the same! Be it possession, OC, water... It's truly NEELKANTH"S KINGDOM! Narayan

The project has gotten delayed way beyond what is coinsidered as acceptable. I have also booked a flat in the Kingdom property and am concerned about the delay. Is any effort beoing made to organize a group so that we can take our issues to the consumer court?

all partners of neelkanth kingdom group skin is thicker than rhyno, since november we are patiently hearing builder's assurances, indirectly builders are buying time by giving false assurances, and we are wasting our precious time and money without having fruitful result. now time has come to appoint good advocate and start legal action, this is only option left to us.

weak point of builder is
1. they are afraid of media adverse publicity.
2. they are afraid of their future projects/sales/reputation.
3. they are afraid of their rest of running project should not be affected.
4. they have huge public money in hand, they know individual person dont have that much capacity to fight.
5. they are taking advantage of our weak point.
6. now time has come we should attack on builders weak point i.e. appointing advocates and initiate of legal action as soon as possible.

This is Sriram Iyer
I have 2 flats booked at Neelkanth Kingdom.Since I do not live in the country I am dependent on your good support to get to the next step towards completing the project.
I appreciate the fact that we need to go to an Advocate. Unfortunately, we still need to have a plan of action that will enable completion of the project as we meet legal experts and also go thru' other avenues including Site Meetings

So,my line of thought
1) Form a cooperative society as we have the minimum numbers required for the same.
2) Every one should understand that we cannot stop payment to banks for the home loan provided. The agreement is with the bank and ourselves as individuals. Hence

We should seek a stop of disbursements of all payments made from the ESCROW account of the partners unless an independent (mutually agreed / court apporved) Chartered Engineer/Architect certifies the completion percentage. (Flat wise / building wise)

This should also apply for any new sale made by the Builder

3 The court should mandate that only 90% of the approved value should be disbursed. In case any one partner is willing to continue work we need to support this partner in this arrangement (We divide them)

4 The builder has agreed for liquidated damages. My suggestion that the compensation be fair is on four factors
A)Actual amount paid to the builder by individual
B)The date it had been paid
C)Delayed period for building completion
D) Rate of interest
We arrive thus at a formulae which we can present to the court for compensation amount that individuals ( or society as a whole gets - Helps in formation costs etc)get.

5)The group needs some money initially to file a case in the court. I suggest individual contribution against flat members of a reasonable amount which can be adjusted against society contributions later ( if not compensated by the builder)

While this blog by Dr Banushali is a good step, my suggestion of a second step will be to notify one person with the following datails

1)Name of flat owner
2)Flat no and name of building
3)E mail id (For sending common mail)
4)Mobile no (for SMS etc)
-- The easy way-We should ask this list in the next meeting with the builder

Let this individual act as a Publicity Manager and ensure all concerned are sent am e mail.

During every site visit, we visit a set of randomly selected flats in each building and see the progress. A simple table can be prepared and the result posted on the net. Poor progress means bad news for the builder and good progress will certainly help him.

I am willing to support any other way even while sitting in Dubai. I will attend the Sunday Meeting Scheduled for End June / Eary July when I am in Mumbai.

We are being played upon like a cat toys with mouse. Unfortunately we are only too keen to follow the 'keep begging' with the builder line of action which has yielded no results for years now.

I am of the strong opinion that you cannot appeal to the finer sensibilities of one who has neither conscience nor self-respect.

Can we please move towards more concrete action as far as litigation is concerned?

Dear Kathik,

when we were having a meeting yesterday at the site with the builders what was more insulting is that the Partner Mr Tulsi was smiling and laughing around as if the whole proceeding was a joke.

I think he was laughing on 400 People as if we are fools. Also when he went out after the proceedings got over he was cursing the Gujrati Samaj.

Unity of all the buyers seems to have truly worked. i have heard rumors that one of the partners is now disposing their share to another builder who is very secular minded and who will finish everything very fast by selling the pending apartments.God bless this builder. Hopefully we shall soon have a truly cosmopolitan and secular neelkanth kingdom fully finished . Can somebody pls confirm this ?

Read ur blog dated 08.12.2008 on 20.12.10.
We the residents of Girija,Neelkanth Heights are facing the same problems as you did.We do not have an O.C. nor a registered society for the past three years.We are now planning for a legal help.Kindly let us know of your lawyer who can help us in taking up our case.
